    Will your mattress make me hot?

    Stearns & Foster® designs every mattress with breathable materials to keep them as cool as they are comfortable. 

    AirVent System: Ventilated coil systems work with external air vents to help prevent heat buildup in your mattress to promote cool, comfortable, deep slumber throughout the night. 

    Top Panel with Tencel™: A stretch-knit covering featuring Tencel, a sustainably sourced fiber used in athletic wear, designed to wick away moisture. Can I use my electric blanket or heating pad with my mattress? 

    We recommend you do not use either electric blankets or heating pads with our mattresses. Longer periods of exposure to the heat from electric blankets or heating pads may damage the mattress. 

    Do consumers need to rotate their mattress?

    Yes, we recommend that consumers occasionally rotate their Stearns & Foster mattress. They no longer need to flip their mattress.  

    Why do consumers need a power base?

    A power base is the perfect choice for consumers who want to relax or sleep with virtually unlimited ergonomic positions. 

    All Stearns & Foster mattresses are compatible with EASE®, TEMPUR-Ergo® and TEMPUR-Ergo® Extend power bases.

    For delivery, can a Stearns & Foster mattress be bent?

    Yes, delivery staff can bend the mattress during delivery if absolutely needed. We do not recommend bending farther than 45 degrees; bending more could damage the coil structure. We recommend measuring and checking dimensions beforehand to ensure ease of delivery. 

    Where are Stearns & Foster mattresses built?

    Stearns & Foster mattresses are all crafted in the U.S. at various facilities around the country. 

    What is a foundation?

    Our foundations look similar to a standard box spring. But instead of the “give” of a box spring, our foundations provide a solid base for our mattresses. 

    Why do consumers need a foundation?

    Foundations help support the mattress to prevent bowing or sagging. A flat surface with sufficient center support is required to ensure complete warranty protection for a Stearns & Foster mattress. 

    What are Stearns & Foster flat foundations made of?

    All Stearns & Foster flat foundations are made from high-grade wood, with a support structure constructed from high-gauge steel wire. 

    Do I have to purchase your foundation?

    We encourage you to buy a foundation when you buy your mattress; it provides the solid base your mattress requires to do its job properly. If you choose not to purchase our foundation, you must position the mattress on a completely flat, solid surface with adequate center support. Please note that using the mattress without a Stearns & Foster foundation or similar firm, solid-surface, non-spring base may void the warranty. 

    Can I put your mattress on my existing box spring?

    No, you should not place the mattress on a box spring. Box springs are designed to “give-in” supporting a traditional mattress, while Stearns & Foster mattresses require a solid base. 

    I have a platform bed. Do I have to buy your foundation?

    If your platform bed has a solid surface and strong center support that can properly support the mattress, you can use it instead of a foundation. However, if the platform bed uses slats to support the mattress, you may be using an improper foundation that will void your warranty. 

    Can I place a piece of particleboard or plywood over a box spring to create a flat surface for my mattress?

    No. A box spring is designed to support a traditional spring mattress, and it “gives.” Placing a piece of particleboard or plywood over a box spring will produce a surface that is unstable and will void your warranty. 

    How much weight will your foundation hold?

    We designed each of our foundations to support the weight of a mattress plus two persons resting on top. Each foundation is designed to support approximately 600 pounds of weight.

    THIS LIMITED WARRANTY CONTAINS A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER PROVISIONS THAT WAIVE YOUR RIGHT TO A COURT HEARING, RIGHT TO A JURY TRIAL, AND RIGHT TO PARTICIPATE IN A CLASS ACTION. PLEASE READ ALL TERMS HEREIN CAREFULLY AS THEY AFFECT YOUR RIGHTS.

    Your purchase of this product indicates acceptance of these terms. All parts of this Limited Warranty apply to the maximum extent permitted by law or unless prohibited by law. This Limited Warranty gives the purchaser specific legal rights, and the purchaser may also have other rights, which may vary from state to state.

    What Should I Do If A Problem Occurs?

    First, contact the retailer where you purchased your sleep set. If you cannot reach the retailer, or if you have moved, contact our Customer Service line at 1-866-783-2767.

    WARRANTY DESCRIPTION

    All Stearns & Foster® mattresses and non-adjustable foundations are covered by the terms of this Limited Warranty. For purposes of this Limited Warranty, the term “product” means any Stearns & Foster non-adjustable foundation and any mattress manufactured by or for Sealy Mattress Manufacturing Company, LLC (“Sealy”). Sealy warrants that it will, at Sealy’s option, replace Purchaser’s Stearns & Foster product sold in the U.S. by an authorized retailer if that product is defective due to faulty workmanship or materials, subject to the limitations described in this Limited Warranty. Sealy undertakes no responsibility for the quality of the products except as provided in this Limited Warranty, and there are no warranties that extend beyond the description provided herein. WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. This Limited Warranty is valid only in connection with the original purchase of new products from authorized retailers and extends from the original purchase date of the original product. An “original purchaser,” for the purposes of this Limited Warranty, is an individual or entity who purchases the product directly from Sealy or an authorized retailer of Sealy with the intent to use the product for personal consumer use and not for commercial or industrial use and not with the intent to resell the product. An “authorized retailer,” for purposes of this Limited Warranty, is an individual or entity authorized by Sealy to sell product directly to original Purchasers. An individual or entity that purchases the product from whatever source with the intent to resell the product is an unauthorized reseller (“unauthorized reseller”).

    This Limited Warranty does not apply to floor models or “demos” or to products sold by unauthorized resellers, including, without limitation, unauthorized resellers on third-party websites. Unauthorized resellers are not “original purchasers” for the purpose of this Limited Warranty. If Purchaser is not the original purchaser of this product, Purchaser takes the product “AS IS,” “with all faults” and without warranty. If the purchase of this product was not directly from Sealy, proof of purchase will be required to demonstrate that the product was purchased from an authorized retailer, and Purchaser is eligible to make a valid claim under this limited warranty.

    MATTRESSES

    Stearns & Foster mattresses are designed to work on a firm solid-surface, non-spring foundation or adjustable bed base that is structurally capable of supporting the weight of Purchaser’s Stearns & Foster mattress and user(s). This Limited Warranty and other performance warranties are based on tests conducted on “sets” that consist of our mattresses and our foundations/adjustable bed bases. This Limited Warranty only covers manufacturing defects in a mattress or foundation when the set is subject to proper handling and normal use in conjunction with a bed frame that provides Continuous Support. To provide Continuous Support, a Queen or King frame must have a rigid bridge bar with at least 5 support legs, or 5 equally spaced hardwood cross-slats with a supporting center leg. Sealy may require Purchaser to provide proof of the quality of the foundation, adjustable bed base, or bed frame used in conjunction with the mattress if Purchaser makes a claim under this Limited Warranty. Sealy makes no representations whatsoever as to the structural integrity or rated load for any frame, foundation, or adjustable base not manufactured by or for Sealy. Coverage under this Limited Warranty is excluded if the foundation, base, or frame is determined, in Sealy’s reasonable discretion, to be inadequate, or if the mattress is found to be in an unsanitary condition.

    How long will the warranty last?

    The length and terms of this warranty may be determined from information contained on the law tag attached to the mattress.

    What is and is not covered by the warranty?

    Sealy warrants that it will, at Sealy’s option, replace Purchaser’s Stearns & Foster mattress sold in the U.S. by an authorized retailer if that product is defective due to faulty workmanship or materials, subject to the limitations described in this Limited Warranty.

    THIS LIMITED WARRANTY DOES NOT COVER:

    Comfort preference

    Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains. However, if there is a warranty defect not caused by the abuse or damage, then the mattress would be covered under the limited warranty.

    Damage associated with an improper bed frame, foundation, or adjustable base. See above description of a proper bed frame.

    Replacement of another piece in the Stearns & Foster sleep system (e.g., mattress, adjustable base, pillows, etc.) unless the other piece is also defective.

    Floor models or demonstration samples (“demos”).

    Product sold by unauthorized resellers.

    Product sold “as-is,” “preconditioned,” “reconditioned,” “used,” “comfort return,” “returned,” “previously owned,” or any other similar wording indicating that the product is not “new” or of “first quality,” or has previously been purchased or used by another consumer.

    Normal indentations or sagging of less than 1 ½″ for quilted or tufted top mattresses, or less than ¾” for flat top panel mattresses without any quilting or tufting. If it is determined that an indentation is caused by misuse, abuse or factors other than a product defect, this warranty will not cover that condition.

    Odors

    Mildew or mold occurring after use of the mattress.

    Damage caused by other actions or events beyond Sealy’s reasonable control.

    FLAT, NON-ADJUSTABLE STEARNS & FOSTER FOUNDATIONS

    Stearns & Foster foundations are designed to work with a bed frame capable of supporting the load of the foundation and an approved mattress. This Limited Warranty and other performance warranties are based on tests conducted on “sets” that consist of our mattresses and our foundations. Sealy may require Purchaser to provide proof of the quality of the bed frame or mattresses used in conjunction with the foundation if Purchaser makes a claim under this limited warranty. Sealy makes no representations whatsoever as to the structural integrity or rated load for any frame not manufactured by or for Sealy. Coverage under this Limited Warranty is excluded if the frame is determined, in Sealy’s reasonable discretion, to be inadequate or if the foundation is found to be in an unsanitary condition.

    THIS LIMITED WARRANTY COVERS THE FOLLOWING ITEMS DURING NORMAL WEAR:

    Structural damage or broken components.

    Squeaks or rattles.

    Sagging that is not associated with use of an improper bed frame and does not result from physical abuse or damage to the foundation, or other misuse of the foundation.

    THIS LIMITED WARRANTY DOES NOT COVER:

    Structural damage from using an improper bed frame.

    Physical abuse or damage to the structure and/or cover material of the foundation, including but not limited to, burns, cuts, tears, or liquid damage.

    Replacement of another piece in the Stearns & Foster sleep system (e.g., mattress, adjustable base, pillows, etc.) unless other piece is also defective.

    Floor models or demonstration samples.

    Product sold by unauthorized resellers.

    Product sold “as-is,” “preconditioned,” “reconditioned,” “used,” “comfort return,” “returned,” “previously owned,” or any other similar wording indicating that the product is not “new” or of “first quality,” or has previously been purchased or used by another consumer.

    Damage caused by other actions or events beyond Sealy’s reasonable control.

    PRODUCT REPLACEMENT TERMS

    Except as otherwise provided herein, Sealy will not charge purchaser to replace Purchaser’s mattress or flat foundation with the same or current comparable model if it is deemed defective during the length of this Limited Warranty, but any transportation costs associated with replacements are Purchaser’s responsibility. In no event, however, will the transportation costs exceed Sealy’s then-standard freight charges. No new warranty is provided with a replacement product. The warranty for the replacement product runs from the date of original purchase of the replaced product.

    In connection with the replacement of a product in compliance with the terms of this Limited Warranty, if a Purchaser elects to upgrade to a more expensive product, they may do so by paying the difference between the cost of the original product being replaced and the cost of the upgraded product plus the cost of any related additional sleep system pieces not being replaced as part of the warranty exchange. In the event of an upgrade as described in this paragraph, a new warranty will be provided for the upgraded pieces only.

    ADDITIONAL LIMITATIONS ON WARRANTY COVERAGE

    In the event a warranty claim is filed, and a warranty replacement is deemed necessary, Purchaser will be required to surrender the original product to Sealy at the time of replacement unless local disposal is allowed by Sealy.

    THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND SEALY’S ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. SEALY’S LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT.

    SEALY EXPRESSLY DISCLAIMS, AND SHALL NOT BE LIABLE FOR, INCIDENTAL OR CONSEQUENTIAL DAMAGES RELATING TO, OR RESULTING FROM USE OF THE PRODUCTS, OR ARISING OUT OF ANY NEGLIGENCE OR BREACH OF THIS WARRANTY. THE EXCLUSIVE REMEDY FOR BREACH OF THIS WARRANTY SHALL BE REPLACEMENT OR CREDIT TOWARDS REPLACEMENT AS SET FORTH HEREIN.

    SEALY IS NOT LIABLE FOR ANY DAMAGES CAUSED BY THE PRODUCT OR THE FAILURE OF THE PRODUCT TO PERFORM, INCLUDING ANY LOST PROFITS, LOST SAVINGS, INCIDENTAL DAMAGES, OR CONSEQUENTIAL DAMAGES. SEALY IS NOT LIABLE FOR ANY CLAIM MADE BY A THIRD PARTY OR MADE BY YOU FOR A THIRD PARTY.

    THIS LIMITATION APPLIES WHETHER DAMAGES ARE SOUGHT, OR A CLAIM MADE, UNDER THIS WARRANTY OR AS A TORT CLAIM (INCLUDING NEGLIGENCE AND STRICT PRODUCT LIABILITY), A CONTRACT CLAIM, OR ANY OTHER CLAIM. THIS LIMITATION CAN NOT BE WAIVED OR AMENDED BY ANY PERSON. THIS LIMITATION OF LIABILITY WILL BE EFFECTIVE EVEN IF SEALY OR AN AUTHORIZED REPRESENTATIVE OF SEALY HAS BEEN ADVISED BY YOU OF THE POSSIBILITY OF ANY SUCH DAMAGES. THIS LIMITATION OF LIABILITY, HOWEVER, WILL NOT APPLY TO CLAIMS FOR PERSONAL INJURY.

    SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

    How is TEMPUR® Material different from typical memory foam?

    Unlike ordinary memory foam, TEMPUR® Material’s precision-engineered cellular structure immediately and precisely adapts to your weight, shape, and temperature. Your body heat causes the material to soften, continuously adapting to your shape while you sleep.

    Does Tempur-Pedic® offer any mattresses with a more traditional spring-coil feel?

    Our hybrid models include 1000+ premium spring coils designed in-house to work with our proprietary material. They provide a more traditional feel and ease of movement. A hybrid option is available in Adapt, ProAdapt and PRObreeze°. 

    What is a Split King?

    A Split King bed is made of two Twin Long mattresses, allowing you to share your bed without compromising your individual sleep preferences.

    Why switch to a Split King?

    Personalized feel: Mix and match the same feel or different feels to get a personalized sleep space for your best night’s sleep. Personalized adjustability: Add an adjustable base for your own personalized experience. Sleep flat on your side while they sit up and read on theirs. 

    What sheets do I need for a Split King?

    A regular King-size fitted bed sheet will fit over both mattresses. However, for adjustable base use, it’s recommended two Twin Long sheets be purchased. All Tempur-Pedic® brand sheets offer sets in both Split King and Split CA King sizes. 

    A set will include: 

    2 Split King fitted sheets 

    1 King flat sheet 

    2 King pillowcases 

    Does CA King have a split option?

    Yes.  It is called a California (CA) split king

    Will the Split King beds separate?

    Under normal conditions, the beds will not separate — particularly if they are used within a piece of furniture that surrounds the bed to help define the space. Even without a piece of furniture, it is rare that the beds will separate, as the weight of the bases and the mattresses will require a decent amount of force to move.  

    How long will it take to get used to my new mattress?

    If you’re used to a traditional mattress, your new Tempur-Pedic® mattress may take some getting used to. As you sleep on the mattress, it will respond to your body weight and temperature, conforming to your body, and feeling more “natural." This “break-in” period lasts for a couple of weeks. During this time, the TEMPUR® cells are fully opening, so they can optimally adjust to temperature changes and weight. 

    Will your mattresses fit my current bed furniture and frame?

    We design our mattresses to fit most standard-size bed furniture and frames. Unless your product was not designed for the U.S. market, or is an unusual size, our mattresses should fit. If you have any question about whether a Tempur-Pedic® mattress will fit your bed or furniture frame, we recommend that you refer to the specific product dimensions. 

    Can I have different heights of mattresses for each side?

    If the mattresses you choose for your custom Split King/ CA King are of different heights, our Sleep Experts can help you understand how our adjustable bases may be able to help offset differences in mattress height. 

    Will I feel a gap between both mattresses?

    The mattress edges are rounded; therefore, there may be a slight gap, but most owners do not feel it or have issues with it. Additionally, one of the benefits of TEMPUR® Material is that it provides a great edge-to-edge sleeping surface that will minimize any feeling of the “split” in the mattress as long as the mattresses are the same on both sides. If you choose to customize one side or the other, there will be a feel difference when you move from one side of the bed to the other. 

    Will your mattress make me hot?

    We get this question often, but, in fact, sleeping warm on a Tempur-Pedic® mattress is not an issue that our owners raise frequently. Our mattresses are designed to respond to your body temperature, which activates their ability to conform to your body, offering support and reducing pressure points. 

    If you're naturally a hot sleeper, TEMPUR-breeze° mattresses may be a good option for you. Our breeze° series features one-of-a-kind cooling technology to help you stay cooler throughout the night. 

    My new mattress has a slight odor. How long will it last?

    TEMPUR® Material can have a slight odor after it is manufactured. This smell is normal and harmless, and it usually disappears before the product reaches you. If you notice this odor, know that it will dissipate in a week or two. Sometimes it’s helpful to “air out” your mattress for a couple of days, leaving the sheets off when you’re not sleeping on it. 

    Why does my mattress feel firm at times and soft and responsive other times?

    TEMPUR® Material responds to your body weight and heat. It contours to your body, automatically adjusting to your every curve. When not in contact with your body, the material returns to its usual shape (which it’s designed to do, so it feels like new every time you sleep on it), so it can feel slightly firmer when you first lie down. After you have been on the mattress awhile, the material responds to your body heat and starts to feel more conforming and responsive. TEMPUR® Material is also temperature sensitive. If you keep your room too hot or too cold, it may feel softer or firmer. 

    Do I need to flip my mattress?

    Since our mattresses are designed so you do not have to flip or rotate them, you’ll never have to face that backbreaking task. In fact, you should not flip our mattresses — they all have a top side that’s designed for sleeping.

    Can I fold my mattress?

    We recommend storing your mattress flat. However, if you’re moving the mattress, it may be folded. Be sure to fold it with the top side facing in on itself. If the mattress sits folded in cold weather for hours, do not try to force it to “unfold” when you place it in your room — it will naturally return to its original shape over the course of a couple of hours.  

    Can I use an electric blanket or heating pad with my mattress?

    We recommend you do not use either electric blankets or heating pads with our mattresses. Longer periods of exposure to the heat from electric blankets or heating pads may damage the mattress. 

    What happens if I spill liquid on my mattress?

    If you spill liquid on your Tempur-Pedic mattress, you can take the following steps. Please note that any stain or odor may not be completely removed. 

    For mattresses with a non-removable cover: Soak up as much of the liquid as possible using towels (you may have to push down on the material with the towels). Once you’ve removed the excess moisture, let the mattress air-dry (you can use a fan to blow directly on the mattress to speed up the process). 

    For mattresses with a removable cover: Remove the zippered cover from the mattress.  While the cover is removed, soak up as much of the liquid as possible using towels (you may have to push down on the material with the towels). Once you’ve removed the excess moisture, let the mattress air-dry (you can use a fan to blow directly on the mattress to speed up the process). Wash the cover in cold water with mild detergent. Line dry for best results. Never use bleach or bleaching products with the cover 

    Note: We offer a mattress protector that can provide extra protection against spills. It’s specially designed to fit all Tempur-Pedic mattresses, and highly stretchable to move with the mattress as it conforms to your body. It traps liquids to keep the mattress clean and stain free, and provides an additional allergen barrier to deter bacteria and dust mites. 

  • TEMPUR-PEDIC WARRANTY

    REST EASY

    Your new Tempur-Pedic® mattress and flat foundation are covered by a 10-Year Full Replacement Limited Warranty. For 10 years after you purchase your new mattress or foundation from Tempur-Pedic or an authorized Tempur-Pedic Retailer, when it has a defect covered under the warranty, we will replace or repair it. This includes all parts of the mattress and foundation, and there’s no deductible. The details of this warranty, and some limitations, are provided in the complete Warranty Description on the following pages.

    WARRANTY DESCRIPTION

Tempur-Pedic North America, LLC (“Tempur-Pedic”) warrants that it will, at Tempur-Pedic’s option, replace or repair Purchaser’s Tempur-Pedic product sold in the U.S. by an authorized retailer if that product is defective due to faulty workmanship or materials, subject to the limitations described in this Limited Warranty. Tempur-Pedic undertakes no responsibility for the quality of the goods except as otherwise provided in this contract. There are no warranties that extend beyond the description on the face hereof. This Limited Warranty is valid only in connection with the original purchase of new products from authorized retailers and extends from the original purchase date of the original product purchased. An “original purchaser,” for the purposes of this Limited Warranty, is an individual or entity who purchases the product directly from Tempur-Pedic or an authorized retailer of Tempur-Pedic with the intent to use the product for personal consumer use and not for commercial or industrial use and not with the intent to resell the product. An “authorized retailer,” for purposes of this Limited Warranty, is an individual or entity authorized by Tempur-Pedic to sell product directly to original purchasers. An individual or entity that purchases the product from whatever source with the intent to resell the product is an unauthorized reseller (“unauthorized reseller”).

    This Limited Warranty does not apply to floor models or “demos” (except as specifically provided herein) or to products sold by unauthorized resellers, including without limitation, unauthorized resellers on third party websites, including, without limitation, Craigslist, eBay, Amazon, etc. Unauthorized resellers are not “original purchasers” for the purpose of this Limited Warranty. If purchaser is not the original purchaser of this product, purchaser takes the product “AS IS,” “with all faults” and without warranty. IF THE PURCHASE OF THIS PRODUCT WAS NOT DIRECTLY FROM TEMPUR-PEDIC, PROOF OF PURCHASE WILL BE REQUIRED TO DEMONSTRATE THAT PURCHASER IS THE ORIGINAL PURCHASER AND THE PRODUCT WAS PURCHASED FROM AN AUTHORIZED RETAILER, AND ELIGIBLE TO MAKE A VALID CLAIM UNDER THIS LIMITED WARRANTY.

    Mattresses

    Tempur-Pedic mattresses are designed to work on a firm, solid-surface, non-spring foundation or adjustable bed base that is structurally capable of supporting the weight of purchaser’s Tempur-Pedic mattress and user(s). This Limited Warranty and other performance warranties are based on tests conducted on “sets” that consist of our mattresses and our foundations/adjustable bed bases. THEREFORE, IF PURCHASER USES INAPPROPRIATE FOUNDATIONS, BOX SPRINGS, ADJUSTABLE BED BASES, OR BED FRAMES WITH THE MATTRESS, SUCH USE WILL VOID THIS LIMITED WARRANTY AND ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

    Tempur-Pedic may require purchaser to provide proof of the quality of the foundation, adjustable bed base, or bed frame used in conjunction with the mattress if purchaser makes a claim under this Limited Warranty. Tempur-Pedic makes no representations whatsoever as to the structural integrity or rated load for any frame, foundation, or adjustable base not manufactured by or for Tempur-Pedic. Tempur-Pedic reserves the right to invalidate this Limited Warranty if the foundation is determined, in Tempur-Pedic’s reasonable discretion, to be inadequate or if the mattress is found to be in an unsanitary condition.

    This Limited Warranty covers the following items during normal wear:

    Deterioration causing the mattress to have a visible indentation greater than three- fourths (0.75) of an inch that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation or adjustable bed base. Normal wear requires that a purchaser’s mattress be continuously supported by a matching foundation or adjustable bed base with a proper bed frame sufficient to support the collective weight of the mattress and foundation.

    A proper bed frame must provide sturdy support for both the mattress and foundation; including a center support and having at least 5-6 legs for queen, king and cal king and 4 leg support for twin and full mattresses. For queen, king, and cal king slatted style bed frames, it is incumbent upon purchaser to ensure that the frame utilized offers ample structural support for the mattress and foundation in view of that particular slatted style frame. Failure to have a proper bed frame may invalidate the limited warranty. The use of a bed frame is important for the life and protection of your sleep system. Neither mattresses, individually, nor sleep systems (mattress and foundation combination) are intended to sit/lay flat on the floor or on a waterbed frame or platform of untreated wood or untreated wood covered with fabric.

    Please Note: Tempur-Pedic highly recommends a 3-bed beam support system (available from Tempur-Pedic or Retailer at an additional cost) or a support system of similar quality that is designed specifically to give slatted style bed frames for queen, king and cal king mattresses additional structural support.

    Any physical flaw in the mattress that causes the TEMPUR® material to split or crack, despite normal usage and proper handling (as outlined in the Mattress Use & Care Instructions).

    Any manufacturing defect in the zipper assembly of the mattress cover. Tempur-Pedic may, at its own option, repair or replace the cover provided on the mattress. In the event that Tempur-Pedic replaces the mattress cover, Tempur-Pedic will replace it with the current style of cover available for the mattress, which may be of a different color or material than the original cover provided.

    This Limited Warranty does not cover:

    A normal increase in softness of the TEMPUR® pressure-relieving material which does not affect the pressure-relieving qualities of the mattress.

    Comfort preference.

    Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains. However if there is a warranty defect not caused by the abuse or damage then the mattress would be covered under the standard warranty.

    Damage associated with an improper bed frame, foundation, or adjustable base. See above description and illustrations for a proper bed frame.

    Replacement of the accompanying piece in the Tempur-Pedic sleep system where only one piece is defective, unless that accompanying piece is also defective.

    Floor models or demonstration samples (“demos”) sold at a discount (See separate warranty for demos and floor models).

    Product sold by resellers who are not authorized retailers.

    Product sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the product is not “new” or of “first quality”, or has previously been purchased or used by another consumer.

    Product Replacement Terms

    Except as otherwise provided herein, Tempur-Pedic will not charge purchaser to repair or replace purchaser’s mattress or flat foundation if it is deemed defective during the length of this 10 year Limited Warranty, but any transportation costs associated with repairs or replacements are purchaser’s responsibility. In no event, however, will the transportation costs exceed Tempur-Pedic’s then standard freight charges. No new warranty is provided with a replacement product. The warranty for the replacement product runs from the date of original purchase of the replaced product. Be it noted that any pump, hose or remote provided with, or contained with, any Tempur-Pedic product is warranted for five (5) years, such period commencing from the time of purchase of the product except if the product is a demonstration or floor model, which in such case the warranty period commences with the manufacturing date of the product as provided on the product’s law tag. In the event that such pump, hose or remote is deemed defective, Tempur-Pedic may, at Tempur-Pedic’s choice, repair or replace such component. In the event that repair is necessary, such repair will be at no charge to the Purchaser except for transportation costs associated with such repair or replacement. In connection with the replacement of a product in compliance with the terms of this Limited Warranty, if a purchaser elects to upgrade to a more expensive product, it may do so by paying the difference between the cost of the original product being replaced and the cost of the upgraded product plus the cost of any related additional sleep system pieces not being replaced as part of the warranty exchange. In the event of an upgrade as described in this paragraph, a new warranty will be provided for the upgraded pieces only.

    Demonstration Samples and Floor Models

    Except as otherwise provided herein regarding the pump, hose or remote provided with, or contained within, a Tempur-Pedic product, demonstration samples (“demo(s)”) and floor model(s) will enjoy a 10 year limited warranty from the date of purchase provided on the receipt. However, except for verifiable warranty defects, demos and floor models are sold “as is” and “with all faults” and covers on demos and floor models (whether removable or not) are not warranted or guaranteed. During this Limited Warranty, demo or floor model products purchased at a discount will be repaired by Tempur-Pedic at no charge to the purchaser or will be replaced for a charge equal to the cost of the replacement product less the amount paid by the original purchase for the demo or floor model. If the demo or floor model product has been discontinued then the replacement charge will be the cost of the reasonable equivalent of the discontinued item (or any upgraded item) less the amount paid by the original purchaser for the demo or floor model product.

    Mattress Covers

    If removable, the cover (except for demo or floor model covers) initially provided for the Tempur-Pedic product is warranted for ten (10) years from the date of purchase against faults in material or workmanship. Tempur-Pedic reserves the right to repair said cover. In the event that Tempur-Pedic replaces the cover for the mattress, Tempur-Pedic will replace it with the current style of cover available for the mattress, which may be a different color or material than the original cover.

    Flat, Non-Adjustable Tempur-Pedic Foundations

    Tempur-Pedic foundations are designed to work with a bed frame capable of supporting the load of the foundation and an approved mattress. This Limited Warranty and other performance warranties are based on tests conducted on “sets” that consist of our mattresses and our foundations. THEREFORE, IF PURCHASER USES INAPPROPRIATE MATTRESSES OR BED FRAMES WITH THIS FOUNDATION, SUCH USE WILL VOID THIS LIMITED WARRANTY AND ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Tempur-Pedic may require purchaser to provide proof of the quality of the bed frame or mattresses used in conjunction with the foundation if purchaser makes a claim under this limited warranty. Tempur-Pedic makes no representations whatsoever as to the structural integrity or rated load for any frame not manufactured by or for Tempur-Pedic. Tempur-Pedic reserves the right to invalidate this Limited Warranty if the frame is determined, in Tempur-Pedic’s reasonable discretion, to be inadequate or if the foundation is found to be in an unsanitary condition.

    This Limited Warranty covers the following items during normal wear:

    Structural damage or broken components.

    Squeaks or rattles.

    Sagging that is not associated with use of an improper bed frame.

    This limited warranty does not cover:

    Structural damage from using an improper bed frame.

    Physical abuse or damage to the structure and/or cover material of the foundation, including but not limited to, burns, cuts, tears, or liquid damage.

    Replacement of another piece in the Tempur-Pedic sleep system (e.g., mattress, adjustable base, pillows, etc.) unless other piece is also defective.

    Product sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the product is not “new” or of “first quality”, or has previously been purchased or used by another consumer.

    Foundation Replacement

    Tempur-Pedic will not charge purchaser to repair or replace purchaser’s foundation if it is deemed defective, but any transportation costs associated with repairs or replacements are purchaser’s responsibility. In no event, however, will the transportation costs exceed Tempur-Pedic’s then-standard freight charges. No new warranty is provided with a replacement foundation. The warranty for the replacement foundation runs from the date of original purchase of the replaced foundation. In connection with the replacement of a product in compliance with the terms of this Limited Warranty, if a purchaser elects to upgrade to a more expensive product, it may do so by paying the difference between the cost of the original product being replaced and the cost of the upgraded product plus the cost of any related additional sleep system pieces not being replaced as part of the warranty exchange. In the event of an upgrade as described in this paragraph, a new warranty will be provided for the upgraded pieces only.

    Foundation Demonstration Samples and Floor Models

During the Limited Warranty, demo or floor model products purchased at a discount will be repaired by Tempur-Pedic at no charge to the purchaser or will be replaced for a charge equal to the cost of the replacement foundation less the amount paid by the original purchase for the demo or floor model. If the demo or floor model product has been discontinued then the replacement charge will be the cost of the reasonable equivalent of the discontinued item (or any upgraded item) less the amount paid by the original purchaser for the demo or floor model product.

    Additional Limitations on Warranty Coverage

    In the event a warranty claim is filed and a warranty replacement is deemed necessary, purchaser will be required to surrender the original product to Tempur-Pedic at the time of replacement. TEMPUR-PEDIC SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF THIS PRODUCT OR ARISING OUT OF ANY BREACH OF THIS WARRANTY; THE EXCLUSIVE REMEDY FOR BREACH OF THIS WARRANTY SHALL BE REPLACEMENT OR CREDIT TOWARDS REPLACEMENT AS SET FORTH HEREIN. THERE ARE NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THE WARRANTY DESCRIBED ON THE FACE OF THIS LIMITED WARRANTY.

    Binding Arbitration and Class Action Waiver for U.S. Residents

    (a) This section applies to any dispute except it does not include a Dispute relating to the enforcement or validity of your, Tempur-Pedic’s, or any of our licensors’ intellectual property rights. “Dispute” means any dispute, action, or other controversy between you and Tempur-Pedic concerning your TEMPUR-PEDIC mattress or this warranty, whether in contract, warranty, tort, statute, regulation, ordinance, or any other legal or equitable basis. “Dispute” will be given the broadest possible meaning allowable under law.

    (b) In the event of a dispute, you or Tempur-Pedic must give the other a Notice of Dispute, which is a written statement that sets forth the name, address and contact information of the party giving it, the facts giving rise to the dispute, and the relief requested. You must send any Notice of Dispute by U.S. Mail to Tempur-Pedic North America, LLC, ATTN: Office of General Counsel, 1000 Tempur Way, Lexington, KY 40511. Tempur-Pedic will send any Notice of Dispute to You by U.S. Mail to Your address if we have it or to your e-mail address if we have it. You and Tempur-Pedic will attempt to resolve any dispute through informal negotiation within 60 days from the date the Notice of Dispute is sent. After 60 days, you or Tempur-Pedic may commence arbitration.

    (c) You may also litigate any dispute in small claims court in your county of residence or Fayette County, Kentucky if the dispute meets all requirements to be heard in the small claims court. You may litigate in small claims court whether or not you negotiated informally first.

    (d) If you and Tempur-Pedic do not resolve any dispute by informal negotiation or in small claims court, any other effort to resolve the dispute will be conducted exclusively by binding arbitration. You are giving up the right to litigate (or participate in as a party or class member) all disputes in court before a judge or jury. Instead, all disputes will be resolved before a neutral arbitrator, whose decision will be final except for a limited right of appeal under the Federal Arbitration Act. Any court with jurisdiction over the parties may enforce the arbitrator’s award.

    (e) Any proceedings to resolve or litigate any dispute in any forum will be conducted solely on an individual basis. Neither You nor Tempur-Pedic will seek to have any dispute heard as a class action, private attorney general action, or in any other proceeding in which either party acts or proposes to act in a representative capacity. No arbitration or proceeding will be combined with another without the prior written consent of all parties to all affected arbitrations or proceedings.

    (f) Any arbitration will be conducted by the American Arbitration Association (the“AAA”) under its Commercial Arbitration Rules applying U.S. Federal Rules of Procedure and U.S. Federal Rules of Evidence. The AAA Supplementary Procedures for Consumer-Related Disputes will also apply. For more information, see www.adr.org or call 1-800-778-7879. You agree to commence arbitration only in your county of residence or in Fayette County, Kentucky. Tempur-Pedic agrees to commence arbitration only in your county of residence. You may request a telephonic or in-person hearing by following the AAA rules. In a dispute involving $10,000 or less, any hearing will be telephonic unless the arbitrator finds good cause to hold an in-person hearing instead. The arbitrator may award the same damages to you individually as a court could. The arbitrator may award declaratory or injunctive relief only to you individually, and only to the extent required to satisfy your individual claim.

    (g) Tempur-Pedic will promptly reimburse your filing fees and pay the AAA’s and arbitrator’s fees and expenses as provided below. If you reject Tempur-Pedic’s last written settlement offer made before the arbitrator was appointed (“Tempur-Pedic’s last written offer”), your dispute goes all the way to an arbitrator’s decision (called an “award”), and the arbitrator awards you more than Tempur Tempur-Pedic’s last written offer, Tempur-Pedic will give you three incentives: (i) pay the greater of the award or $5,000; (ii) pay twice your reasonable attorney’s fees, if any; and (iii) reimburse any expenses (including expert witness fees and costs) that your attorney reasonably accrues for investigating, preparing, and pursuing your claim in arbitration. The arbitrator will determine the amount of fees, costs, and expenses unless you and Tempur-Pedic agree on them. For purposes of this limited warranty, an email shall be considered a written communication.

    (h) In any arbitration you commence, Tempur-Pedic will seek its AAA or arbitrator’s fees and expenses, or your filing fees it reimbursed, only if the arbitrator finds the arbitration frivolous or brought for an improper purpose. In any arbitration Tempur-Pedic commences, Tempur-Pedic will pay all filing, AAA, and arbitrator’s fees and expenses. Tempur-Pedic may also seek its attorney’s fees or expenses from you in any arbitration. Fees and expenses are not counted in determining how much a dispute involves.

    (i) This warranty governs to the extent it conflicts with AAA’s Commercial Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes.

    (j) To the extent permitted by law, any claim or dispute under this Limited Warranty must be filed within one year in small claims court, an arbitration proceeding, or in court, if so permitted herein. The one-year period begins when the claim or Notice of Dispute first could be filed. If a claim or dispute is not filed within one year, it is permanently barred.

    (k) If the class action waiver is found to be illegal or unenforceable as to all or some parts of a dispute, then it will not apply to those parts. Instead, those parts will be severed and proceed in a court of law, with the remaining parts proceeding in arbitration. If any other provision of this section is found to be illegal or unenforceable, that provision will be severed with the remainder of this section remaining in full force and effect.

    All parts of this Limited Warranty apply to the maximum extent permitted by law or unless prohibited by law. This Limited Warranty gives the purchaser specific legal rights, and the purchaser may also have other rights, which may vary from state to state.

  • SEALY WARRANTY

    All Sealy® mattresses and non-adjustable foundations are covered by the terms of this Limited Warranty. For purposes of this Limited Warranty, the term “product” means any non-adjustable foundation and any mattress manufactured by or for Sealy Mattress Manufacturing Company, LLC (“Sealy”). Sealy warrants that it will, at Sealy’s option, replace or repair Purchaser’s Sealy product sold in the U.S. or Puerto Rico by an authorized retailer if that product is defective due to faulty workmanship or materials, subject to the limitations described in this Limited Warranty. Sealy undertakes no responsibility for the quality of the goods except as otherwise provided in this Limited Warranty. There are no warranties that extend beyond the description on the face hereof. This Limited Warranty is valid only in connection with the original purchase of new products from authorized retailers and extends from the original purchase date of the original product. This Limited Warranty and other performance warranties are based on tests conducted on “sets” that consist of our mattresses and our foundations/adjustable bed bases. Therefore, if purchaser uses inappropriate foundations, box springs, adjustable bed bases, or bed frames with the mattress, such use will void this Limited Warranty and all other warranties whether express or implied, including without limitation, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. The length and terms of this warranty may be determined from information contained on the law tag attached to the mattress.     Sealy may require purchaser to provide proof of the quality of the foundation, adjustable bed base, or bed frame used in conjunction with the mattress if purchaser makes a claim under this Limited Warranty. Sealy makes no representations whatsoever as to the structural integrity or rated load for any frame, foundation, or adjustable base not manufactured by or for Sealy. Sealy reserves the right in its reasonable discretion to deny a claim under this Limited Warranty if the foundation is inadequate or if the mattress is found to be in an unsanitary condition. This Limited Warranty only covers manufacturing defects in a mattress or foundation when the set is subject to proper handling and normal use in conjunction with a bed frame that provides Continuous Support. To provide Continuous Support, a Queen or King frame must have a rigid bridge-bar with at least 5 support legs or 5 equally spaced hardwood cross-slats with a supporting center leg.

    This Limited Warranty does not cover:

    Comfort preference.

    Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains.

    Damage associated with an improper bed frame, foundation, or adjustable base. See above description and see our website for illustrations for a proper bed frame.

    Replacement of the accompanying piece in the Sealy sleep system where only one piece is defective, unless that accompanying piece is also defective.

    Floor models or demonstration samples (“demos”).

    Product sold by unauthorized retailers.

    Product sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the product is not “new” or of “first quality” or has previously been purchased or used by another consumer.

    Also, normal indentations or sagging (not associated with sag in foundation) of less than 1 1/2" for quilted spring mattresses, or less than ¾” for non-quilted foam and hybrid mattresses, IS NOT COVERED. If it is determined that an indentation is caused by misuse, abuse or factors other than a product defect, this Limited Warranty will not cover that condition.

    Odors—since a simple airing out of the mattress upon placement in the home should dissipate any such smells.

    Mildew or mold occurring after use of mattress.

    Product Replacement Terms

    Except as otherwise provided herein, Sealy will not charge purchaser to replace or repair purchaser’s mattress or flat foundation with the same or current comparable model, if it is deemed defective during the length of this Limited Warranty, but any transportation costs associated with replacements are purchaser’s responsibility. The warranty for the replacement product runs from the date of original purchase of the replaced product.

    Flat, Non-Adjustable Sealy Foundations

    Sealy foundations are designed to work with a bed frame capable of supporting the load of the foundation and an approved mattress. This Limited Warranty and other performance warranties are based on tests conducted on “sets” that consist of our mattresses and our foundations. Sealy may require purchaser to provide proof of the quality of the bed frame or mattresses used in conjunction with the foundation if purchaser makes a claim under this limited warranty. Sealy makes no representations whatsoever as to the structural integrity or rated load for any frame not manufactured by or for Sealy. Coverage under this Limited Warranty is excluded if the frame is determined, in Sealy’s reasonable discretion, to be inadequate or if the foundation is found to be in an unsanitary condition.

    This Limited Warranty covers the following items during normal wear:

    Structural damage or broken components.

    Squeaks or rattles.

    Sagging that is not associated with use of an improper bed frame.

    This Limited Warranty does not cover:

    Structural damage from using an improper bed frame.

    Physical abuse or damage to the structure and/or cover material of the foundation, including but not limited to burns, cuts, tears, or liquid damage.

    Replacement of another piece in the Sealy sleep system (e.g., mattress, adjustable base, pillows) unless other piece is also defective.

    Product sold “as-is,” “preconditioned,” “reconditioned,” “used,” “comfort return,” “returned,” “previously owned,” or any other similar wording indicating that the product is not “new” or of “first quality,” or has previously been purchased or used by another consumer.

    Foundation Replacement

    Sealy will not charge purchaser to repair or replace, at Sealy’s option, purchaser’s foundation if it is deemed defective under the terms of this Limited Warranty, but any transportation costs associated with repairs or replacements are purchaser’s responsibility. In no event, however, will the transportation costs exceed Sealy’s then-standard freight charges. No new warranty is provided with a replacement foundation. The Limited Warranty for the replacement foundation runs from the date of original purchase of the replaced foundation.

    Product Upgrades with a Warranty Replacement

    In connection with the replacement of a product in compliance with the terms of this Limited Warranty, if a purchaser elects to upgrade to a more expensive product, they may do so by paying the upgrade fees plus the cost of any related additional sleep system pieces not being replaced as part of the warranty exchange. A new Limited Warranty will be provided for the upgraded pieces only.

    Compressed Mattresses

    Your Sealy mattress may arrive folded to make it easier to handle during delivery. The mattress will naturally unfold as it warms to room temperature. If the outside temperature is below 50ºF when the mattress is delivered, it may take a few hours for a folded mattress to lay flat. Don’t force it. If you try forcing the mattress to flatten when it’s cold you might damage the foams.

    Additional Limitations on Warranty Coverage

    In the event a warranty claim is filed, and a warranty replacement is deemed necessary, purchaser will be required to surrender the original product to Sealy at the time of replacement unless local disposal is allowed by Sealy. SEALY SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF THIS PRODUCT OR ARISING OUT OF ANY BREACH OF THIS WARRANTY. THE EXCLUSIVE REMEDY FOR BREACH OF THIS WARRANTY SHALL BE REPLACEMENT OR CREDIT TOWARDS REPLACEMENT AS SET FORTH HEREIN. THERE ARE NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THE WARRANTY DESCRIBED ON THE FACE OF THIS LIMITED WARRANTY. All parts of this Limited Warranty apply to the maximum extent permitted by law or unless prohibited by law. This Limited Warranty gives the purchaser specific legal rights, and the purchaser may also have other rights, which may vary from state to state.

    BINDING ARBITRATION AND CLASS ACTION WAIVER FOR U.S. RESIDENTS

    (a) This section applies to any dispute except it does not include a Dispute relating to the enforcement or validity of your, Sealy’s, or any of our licensors’ intellectual property rights. "Dispute" means any dispute, action, or other controversy between you and Sealy concerning your Sealy mattress or this warranty, whether in contract, warranty, tort, statute, regulation, ordinance, or any other legal or equitable basis. "Dispute" will be given the broadest possible meaning allowable under law.

    (b) In the event of a dispute, you or Sealy must give the other a Notice of Dispute, which is a written statement that sets forth the name, address and contact information of the party giving it, the facts giving rise to the dispute, and the relief requested. You must send any Notice of Dispute by U.S. Mail to Sealy, Inc., ATTN: Office of General Counsel, 1000 Tempur Way, Lexington, KY 40511. Sealy will send any Notice of Dispute to You by U.S. Mail to Your address if we have it or to your e-mail address if we have it. You and Sealy will attempt to resolve any dispute through informal negotiation within 60 days from the date the Notice of Dispute is sent. After 60 days, you or Sealy may commence arbitration. (c) You may also litigate any dispute in small claims court in your county of residence or Fayette County, Kentucky if the dispute meets all requirements to be heard in the small claims court. You may litigate in small claims court whether or not you negotiated informally first.

    (d) If you and Sealy do not resolve any dispute by informal negotiation or in small claims court, any other effort to resolve the dispute will be conducted exclusively by binding arbitration. You are giving up the right to litigate (or participate in as a party or class member) all disputes in court before a judge or jury. Instead, all disputes will be resolved before a neutral arbitrator, whose decision will be final except for a limited right of appeal under the Federal Arbitration Act. Any court with jurisdiction over the parties may enforce the arbitrator’s award.

    (e) Any proceedings to resolve or litigate any dispute in any forum will be conducted solely on an individual basis. Neither You nor Sealy will seek to have any dispute heard as a class action, private attorney general action, or in any other proceeding in which either party acts or proposes to act in a representative capacity. No arbitration or proceeding will be combined with another without the prior written consent of all parties to all affected arbitrations or proceedings.

    (f) Any arbitration will be conducted by the American Arbitration Association (the "AAA") under its Commercial Arbitration Rules applying U.S. Federal Rules of Procedure and U.S. Federal Rules of Evidence. The AAA Supplementary Procedures for Consumer-Related Disputes will also apply. For more information, see www.adr.org or call 1-800-778-7879. You agree to commence arbitration only in your county of residence or in Fayette County, Kentucky. Sealy agrees to commence arbitration only in your county of residence. You may request a telephonic or in-person hearing by following the AAA rules. In a dispute involving $10,000 or less, any hearing will be telephonic unless the arbitrator finds good cause to hold an in-person hearing instead. The arbitrator may award the same damages to you individually as a court could. The arbitrator may award declaratory or injunctive relief only to you individually, and only to the extent required to satisfy your individual claim.

    (g) Sealy will promptly reimburse your filing fees and pay the AAA’s and arbitrator’s fees and expenses as provided below. If you reject Sealy’s last written settlement offer made before the arbitrator was appointed ("Sealy’s last written offer"), your dispute goes all the way to an arbitrator’s decision (called an "award"), and the arbitrator awards you more than Sealy’s last written offer, Sealy will give you three incentives: (i) pay the greater of the award or $5,000; (ii) pay twice your reasonable attorney’s fees, if any; and (iii) reimburse any expenses (including expert witness fees and costs) that your attorney reasonably accrues for investigating, preparing, and pursuing your claim in arbitration. The arbitrator will determine the amount of fees, costs, and expenses unless you and Sealy agree on them. For purposes of this limited warranty, an email shall be considered a written communication.

    (h) In any arbitration you commence, Sealy will seek its AAA or arbitrator’s fees and expenses, or your filing fees it reimbursed, only if the arbitrator finds the arbitration frivolous or brought for an improper purpose. In any arbitration Sealy commences, Sealy will pay all filing, AAA, and arbitrator’s fees and expenses. Sealy may also seek its attorney’s fees or expenses from you in any arbitration. Fees and expenses are not counted in determining how much a dispute involves.

    (i) This warranty governs to the extent it conflicts with AAA’s Commercial Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes.

    (j) To the extent permitted by law, any claim or dispute under this Limited Warranty must be filed within one year in small claims court, an arbitration proceeding, or in court, if so permitted herein. The one-year period begins when the claim or Notice of Dispute first could be filed. If a claim or dispute is not filed within one year, it is permanently barred.

    (k) If the class action waiver is found to be illegal or unenforceable as to all or some parts of a dispute, then it will not apply to those parts. Instead, those parts will be severed and proceed in a court of law, with the remaining parts proceeding in arbitration. If any other provision of this section is found to be illegal or unenforceable, that provision will be severed with the remainder of this section remaining in full force and effect.

    All parts of this Limited Warranty apply to the maximum extent permitted by law or unless prohibited by law. This Limited Warranty gives the purchaser specific legal rights, and the purchaser may also have other rights, which may vary from state to state.

  • POWER BASES

    Which mattresses can be used with your power base?

    We have made sure that our mattresses are compatible with any of our three power bases.  

    What are the heights of your power bases?

    For the Ease®, the minimum height is 4" (zero clearance) and maximum height of 16". 

    For the TEMPUR-Ergo®, the minimum height is 4" (zero clearance) and maximum height of 16". 

    For the TEMPUR-Ergo® Extend, the minimum height is 8" (zero clearance) and maximum height of 20". 

    What is the weight limit of your power bases?

    Our power bases support up to 650 lbs. each (Twin, Twin Long, Double, Queen, and Split/Dual CA King bases).  

    All power bases will structurally support the recommended weight distributed evenly across the head and foot sections. 

    Power base products are not designed to support or lift the amount of weight in the head or foot sections alone. 

    Will your power base fit in my existing bed frame?

    We have found that the power bases fit inside most modern bed frames. However, they may not fit inside antique bed frames or other non-standard frames. We recommend you measure the inside of the bed frame and compare to the measurements provided to be sure the power base will fit. 

    Where is the serial number on my power base?

    To locate the serial number for your power base, look at the law tag attached to the cover, the power down box under the base and on the frame right below the foot end of the base. It may be easier to see by lifting the foot slightly if possible. The serial number is also printed on the owner’s manual shipped with the base. The serial number can also be found on the back of the remote beneath the battery cover.

  • USE & CARE

    Carrying or moving the mattress

    When possible, two people should carry the mattress flat on its side to reduce the possibility of the mattress becoming damaged. Bending a mattress may damage the innerspring unit; however, flexing the mattress through doorways should not harm it. For Reserve Collection models, three people may be needed to carry the mattress. 

    Cleaning the mattress

    To keep the mattress clean, we recommend that you use a protective mattress pad. Vacuuming is the only recommended cleaning method. To clean a stain, use mild soap with cold water and apply lightly, being careful not to soak the mattress or foundation. Dry cleaning fluids may damage some of the materials in the mattress. 

  • PILLOWS

    How long will it take to get used to my new pillow?

    If you’re used to a traditional pillow, your new Tempur-Pedic pillow may feel different at first, typically more firm than what you’re used to. As you sleep on the pillow, it will respond to your weight and temperature, conforming to your head and neck, and feel more “natural." This “break-in” period lasts for a couple of weeks. During this time, the TEMPUR® cells are fully opening, so they can optimally adjust to temperature changes and weight. 

    How can I keep my pillow fresh?

    For filled pillows, if you want to “clean” your pillow, follow these simple steps to allow the material to breathe and absorb fresh air: Remove the pillowcase and roll the pillow like a sleeping bag. Unroll and repeat this procedure, rolling in the opposite direction. If your pillow has a removable cover, remove the cover and wash in cold water with a mild detergent. Line dry. 

  • FOUNDATIONS & PLATFORMS

    What is a foundation?

    Our foundations look similar to a standard box spring. But instead of the “give” of a box spring, our foundations provide a solid base for our mattresses. 

    Do I have to purchase your foundation?

    We encourage you to buy a foundation when you buy your mattress; it provides the solid base your mattress requires to do its job properly. If you choose not to purchase our foundation, you must position the mattress on a completely flat, solid surface with adequate center support. 

    Please note that using the mattress without a Tempur-Pedic® foundation or similar firm, solid-surface, non-spring base may void the warranty. 

    Can I put your mattress on my existing box spring?

    No, you should not place the mattress on a box spring. Box springs are designed to give in supporting a traditional mattress, while Tempur-Pedic® mattresses require a solid base. 

    I have a platform bed. Do I have to buy your foundation?

    Tempur-Pedic® mattresses are designed to work on a firm, solid-surface, non-spring foundation or adjustable bed base that is structurally capable of supporting the weight of purchaser’s Tempur-Pedic mattress and user(s). This Limited Warranty and other performance warranties are based on tests conducted on “sets” that consist of our mattresses and our foundations/ adjustable bed bases.  

    Therefore, if purchaser uses inappropriate foundations, box springs, adjustable bed bases, or bed frames with the mattress, such use will void this limited warranty and all other warranties, whether expressed or implied, including, without limitation, the implied warranties of merchantability and fitness for a particular purpose. 

    Can I place a piece of particleboard or plywood over a box spring to create a flat surface for my mattress?

    No. A box spring is designed to support a traditional spring mattress, and it “gives." Placing a piece of particleboard or plywood over a box spring will produce a surface that is unstable and will void your warranty. 

    How much weight will your foundation hold?

    We designed each of our foundations to support the weight of a mattress plus two persons resting on top. Each foundation is designed to support approximately 600 pounds of weight.

    Which mattresses can be used with your adjustable base?

    We have made sure that our mattresses are compatible with any of our foundations, power bases, and Smart Bases.

    How long will it take to deliver my mattress?

    On average, your new mattress can be delivered in as few as 7 days. However, since we work directly with the manufacturer, this can vary based on demand. We will keep you updated on your delivery status. Receiving a fresh mattress, direct from the manufacturer is well worth the wait and better than receiving next day delivery of a mattress that has been sitting in a hot warehouse or truck for weeks.

    What is the Price Predictor™?

    The Sleepology Price Predictor™ is a proprietary technology that compares mattress prices and promotions across the internet, regardless of retailer. The lowest price and best combination of promotional offers is then applied to your Sleepology purchase.

    How can Sleepology give me the best deal and promotion across all retailers?

    We do not have employees in our physical retail stores. Instead of paying excess commissions to greedy salespeople, we pass that savings on to you!

    How does the Price Predictor™ compare mattresses from all retailers?

    Mattress retailers do their best to confuse you, the shopper, by using different names for the same mattress to make it impossible for you to compare pricing across retailers. The Price Predictor™ technology not only compares names, but also specifications across retailers so you do not need to do the work yourself.

    How often does the Price Predictor™ update pricing?

    The Price Predictor updates pricing overnight so you have the most updated deals every day. Since pricing is refreshed daily, we cannot honor previous day pricing. This is why we encourage you to complete your purchase the same day a deal is found on your perfect mattress.

    What happens if I find a lower price for the same mattress at another retailer?

    We are confident in our ability to discover the lowest price and additional savings for you. However, if you find a lower price for the same mattress on the same day as the Price Predictor published price, we will double the difference in the form of a refund. If we can't double the difference then your mattress is free! 

  • 100 NIGHT SLEEP TRIAL

    What is the 100 Night Sleep Trial?

    We want you to discover your perfect mattress and know that can mean taking some time to adjust and trying it out in your home. Therefore, we will let you test your new mattress up to 100 nights from day of delivery. We ask you sleep on it for at least 40 nights before initiating a return or exchange. If, after 40 nights, but before 100 nights, you are still not sleeping your best, please contact us.

    What are the fees for returning or exchanging my mattress during the 100 Night Sleep Trial?

    We do not charge for returns or exchanges. Contact us with questions.

    How many 100- Night Sleep Trials do I get?

    You may exchange your mattress one time.

    Which products are included in the 100 Night Sleep Trial?

    Mattresses that qualify for the 100 Night Sleep Trial are indicated on the product page. Please contact us if you have any questions about a specific product.

    Only mattresses with the 100 Night Sleep Trial indication qualify for the in-home trial. Foundations, adjustable bases, mattress toppers, pillows, sheets, mattress protectors do not qualify unless noted otherwise on the product page.

  • HOW DO I KNOW IF I NEED A NEW MATTRESS?

    If you find yourself wanting a nap during the day or dependent on coffee throughout the day you may be a good candidate for a new mattress. This is especially true if you are already getting 7+ hours of sleep a night. In this case, you are likely tossing and turning throughout the night.

    If you get better sleep in a bed other than your own (hotel, friend, etc), it is likely time to replace. 

    If you recently went through a life event such as a marriage, new home purchase, new bedroom furniture purchase, new job, or any other change that would benefit from deeper, more restorative sleep.

    How do I purchase a product at Sleepology?

    Sleepology offers several payment options including major credit cards, debit cards, and various financing options listed during checkout.

    Sleepology does not accept cash.

    Financing through Affirm / Shop Pay? Here’s some details they provided us.

    Installments

    Shop Pay offers you the option to pay in full at checkout, or to split your purchase into regular payments with Shop Pay Installments. Installment options vary by store and can be used on orders over $50 USD, including discounts, shipping, and taxes.

    Four, biweekly, interest-free payments, for orders from 50 USD to 999.99 USD.

    Monthly payments for orders from 150 USD to 17,500 USD. Monthly installment orders are interest-bearing from 10 to 30% APR, and may be paid in three, six, or twelve months depending on the purchase amount.

    Fees or penalties

    For purchases split into 4 bi-weekly payments, there are no additional charges or interest rates applied. Purchases split into monthly payments may be subject to interest. 

    You can pay your balance off early without penalty.

    There are no late fees. However, partial or late payments may affect your ability to use Shop Pay Installments in the future.

    Credit scores and eligibility

    Your credit scores aren't impacted if your purchase is split into 4 bi-weekly payments using Shop Pay Installments. If your purchase is split into monthly payments, then your payments may be reported to a credit bureau.

    To use Shop Pay Installments, your shipping address needs to be in the United States.

    Restricted items

    Add a payment method

    In the Shop app : Sign in to the Shop app. Tap the Account icon in the bottom right corner. In the Shop Pay section, tap Wallet. In the Cards section, tap Add card, then complete the required fields. Confirm or change your billing address. Tap Save card. 

    In Shop Pay on your desktop: Sign into your Shop Pay account. In the Cards section, click the drop-down arrow and choose Add card. Complete the required fields. Confirm your bill to address. If you have to change your billing address: Click the drop-down arrow and select Use a different address. Update your information and click Save billing address. Click Save card. 

    Note: If you want your new payment method to be used for existing purchases that are paid automatically, you need to update the automatic payment settings for each purchase.

    Change my automatic payment method

    Your automatic payment settings aren't universal. That means that if you want to change the payment method for all purchases that have automatic payments, you need to change your settings for each purchase.

    In the Shop app: Sign into the Shop app. In the Home section, tap the purchase that you want to change the automatic payment settings for. Tap View installments. Tap Payment Options. Make sure the Automatic Payment slider is swiped right. Tap the payment method you want to use for this purchase. Note: If the payment method isn’t listed, then tap Use a different card and complete the required fields. 

    In Shop Pay on your desktop: Sign into your Shop Pay account. From the Home page, select the purchase that you want to change the automatic payment settings for. In the Automatic payments section, click Edit. Use the drop-down list to select a payment method or use a different card. Click Update. Click Continue.

    Turn off automatic payments

    You can turn off automatic payments if you want to make manual payments instead. Make sure you turn off the automatic payment setting at least 24 hours before your next payment is due. If you don’t, then your next payment may be processed automatically.

    In the Shop app: Sign into the Shop app. In the Home section, tap the purchase whose payment setting you want to change. Tap View installments. Tap Payment Options. Make sure the Automatic Payment slider is swiped left. 

    In Shop Pay on your desktop: Sign into your Shop Pay account. From the Home page, select the purchase whose payment setting you want to change. In the Automatic payments section, click Edit. Click Disable. Click Turn off. Click Continue.

    Make a manual payment

    In the Shop app: Sign into the Shop app. In the Home section, tap the purchase that you want to make a payment on. Click View installments. Tap Make a payment. In the Amount to pay section, select your preferred option. Note: Custom amounts must be more than $1 and less than or equal to the remaining balance. In the Card section, tap the payment method you want to use. Tap Pay now. Tap Continue. 

    In Shop Pay on your desktop: Sign into your Shop Pay account. From the Home page, select the purchase that you want to make a payment on. Click Make payment. In the Amount to pay section, select your preferred option. Note: If you type a custom amount, then it must be more than one dollar and less than or equal to the total remaining amount.     Early or late payments

    There are no fees or penalties for paying more than your installment amount, or for paying off your whole balance early. However, partial payments or late payments may affect future approvals to use Shop Pay installments.

    Change my payment schedule

    Your payment schedule is based on the date of purchase and can't be changed or combined with another payment schedule. However, you can pay any installment early without any penalty or fee.

  • WHAT IF I DIDN’T GET APPROVED FOR SHOP PAY?

    If you didn’t get approved for Shop Pay Installments

    Check your email inbox for an email from Affirm. This email provides more information about your application. Keep in mind that you might be approved the next time you apply.

    If you can’t find the email, then: Confirm you're checking the same email account that you use for Shop Pay. Check other email folders, such as your Spam or Junk folder.

  • HOW DO I GET A REFUND THROUGH SHOP PAY?

    How to get a refund

    Please contact the store where you bought your item to request a refund. They can let you know whether a return is possible and how much the refund would be, according to their own return policy.

    After they process the refund, the refunded amount will return to your original payment method within 3-10 business days, and your balance will be updated.

    Payments

    While you’re waiting for your refund, please continue to make any payments that are due.

    Refund less than balance

    If your refund is less than your total purchase balance, it might not lower your next payment. Instead, you can expect fewer payments, a smaller final payment, or both.

    If your refund is more than your purchase balance, the difference will be returned to your original payment method within 3–10 business days.

    If you overpaid your total installment balance, we’ll automatically refund the payment method you use to make payments.

    If you overpaid a single monthly payment, the extra amount will be applied to your total installment balance. Or you can fill out this form at the bottom of the linked page to request a refund of the overpaid amount.

    Accidental payments

    Fill out the form below to get a refund for a payment you didn’t mean to make. We’ll start the refund right after your payment processes, and you’ll see your refund 3–10 business days after that.

    Please note that we can refund only the full amount of the accidental payment, not a portion of it. If you’re close to your payment due date, a refund may put you at risk for a late payment.
